After January 2023, the paper previous employer checks process required by 49 CFR Part 40 Section 40.25 will no longer be required. All questions to determine new drivers’ past drug & alcohol violations will need to be done through the Clearinghouse.

The Clearinghouse now has some mandatory queries about driver history and violations. As per 49 CFR, Part 40 Section 40.25 manual paper and previous employer checks will be required. Annual queries of all existing employer drivers will be required as well.

Speakers will include representatives from the FMCSA and Patrice Kelly, Director of the Office of Drug and Alcohol Policy and Compliance (ODAPC) in the Office of the Secretary of the U.S. Department of Transportation (DOT).
Fall of 2019
No specific date has been given, but according to FMCSA, clearinghouse users can register in the clearinghouse in the fall of 2019 to utilize it when it launches on January 6, 2020. Employers subject to FMCSA regulation, covered drivers, medical review officers, substance abuse professionals, state driver’s license agencies, and consortium/third-party administrators are just a few of the users of the clearinghouse.

DOT and FMCSA representatives attended and presented at the annual meeting of the Substance Abuse Program Administrators Association (SAPAA) in Philadelphia, Pennsylvania. Any Clearinghouse-related modifications are anticipated.

In advance of the necessary reporting to the Clearinghouse’s start date of January 6, 2020, Clearinghouse Services, Inc (FCS) was established. The mission of Clearinghouse Services, Inc. is to assist employers in adhering to the Clearinghouse rule’s obligations. Unlimited consultation with employer responsibilities for the clearinghouse is offered as part of membership services. Additionally, FCS is accessible for presentations, consultations, and training related to the Clearinghouse.
